Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Smile ResiPro mobile application, website, content, tools, and related services (“Smile ResiPro” or the “Service”). The Service is provided by Dr. Osama Shaalan (“we,” “us,” or “our”). By downloading, accessing, purchasing, or using Smile ResiPro, you agree to these Terms. If you do not agree, do not use the Service.
1. Professional and educational purpose
Smile ResiPro is an educational and workflow-support tool intended for qualified dental professionals. It provides information concerning composite restoration planning, shade review, layering sequences, clinical workflows, and documentation.
Smile ResiPro does not provide medical or dental diagnosis, treatment, or professional advice. It is not a medical device and is not a substitute for:
- A dentist’s independent professional judgment;
- Direct examination of the patient;
- Appropriate diagnostic procedures;
- Manufacturer instructions for use;
- Applicable professional standards; or
- Local laws and regulations.
All clinical decisions remain the sole responsibility of the treating dental professional. You must independently verify every recommendation before applying it in patient care.
2. Eligibility
You must be at least 18 years old and legally capable of entering into an agreement. Clinical features are intended only for appropriately qualified dental professionals or supervised dental trainees. You are responsible for ensuring that your use of Smile ResiPro is lawful and appropriate in your jurisdiction.
3. Patient information and photographs
You must have all legally required patient permissions before photographing, processing, storing, exporting, or otherwise using dental images.
You agree to avoid unnecessary identifiers, obtain valid consent, follow applicable confidentiality and health-information laws, protect your device against unauthorized access, and delete information when it is no longer needed. You are solely responsible for determining whether your use complies with professional confidentiality and patient-data requirements.
4. Subscriptions and payment
Some features require an auto-renewing subscription. The price displayed in the App Store at purchase controls and may differ by country, currency, tax, and territory.
Payment is charged to your Apple Account after confirmation. Unless cancelled, the subscription renews automatically. Your Apple Account may be charged within 24 hours before the current period ends. You can manage or cancel through Apple Account subscription settings. Deleting the app does not cancel a subscription.
Refunds, billing disputes, and payment processing are governed by Apple’s policies. We do not directly receive or store complete payment-card details. Smile ResiPro uses RevenueCat to support subscription status, purchase validation, entitlement access, and restoration.
5. Restore purchases
“Restore Purchase” may restore an eligible subscription associated with the applicable Apple Account. Restoration depends on Apple and RevenueCat and may require internet access.
6. Acceptable use
You may not use Smile ResiPro unlawfully or unsafely; represent educational output as a guaranteed result; use information without required rights; interfere with or compromise the Service; reverse engineer it except where law permits; copy, resell, sublicense, or commercially redistribute its content; or use it to develop or train a competing product without written permission.
7. Intellectual property
Smile ResiPro, including its software, design, text, graphics, clinical workflows, images, branding, and content, is owned by or licensed to Dr. Osama Shaalan and protected by applicable laws. You receive a limited, personal, non-exclusive, non-transferable, revocable right to use it for its intended purposes. No ownership rights are transferred.
8. User-generated content
You retain your rights in photographs, notes, and other content you create or import and represent that you have the legal right to use it. You are responsible for backups. We are not responsible for loss caused by device failure, deletion, software updates, or circumstances outside our reasonable control.
9. Availability and changes
We may update, modify, suspend, or discontinue features for security, compliance, maintenance, technical, or business reasons. We do not guarantee uninterrupted, error-free, or universal availability or compatibility.
10. Third-party services
Smile ResiPro relies on third parties including Apple and RevenueCat, whose own agreements and privacy practices apply. We are not responsible for third-party outages, App Store decisions, payment delays, or service changes.
11. Disclaimer of warranties
To the maximum extent permitted by law, Smile ResiPro is provided “as is” and “as available.” We do not warrant that clinical or shade-related information will be accurate for a particular patient, that photographic estimates will match direct observation, that a suggested technique will achieve a specific result, that the Service will be uninterrupted, or that device data will never be lost. Mandatory consumer rights remain unaffected.
12. Limitation of liability
To the maximum extent permitted by law, Dr. Osama Shaalan and his employees, contractors, representatives, and licensors will not be liable for indirect, incidental, special, consequential, or punitive damages, data loss, lost profit, lost business, or clinical outcomes arising from use of or inability to use Smile ResiPro.
Total liability will not exceed the amount paid for Smile ResiPro during the twelve months preceding the event giving rise to the claim, unless applicable law requires otherwise. Nothing limits liability that cannot legally be limited.
13. Indemnification
To the extent permitted by law, you agree to indemnify and hold Dr. Osama Shaalan harmless from claims, damages, and reasonable expenses arising from unlawful use, violation of these Terms, infringement of third-party rights, or failure to obtain required patient authorization.
14. Suspension and termination
We may restrict or terminate access if you materially violate these Terms, misuse the Service, or create a security or legal risk. Stopping use or deleting the app does not automatically cancel an App Store subscription.
15. Apple terms
For Apple devices, Apple’s Standard Licensed Application End User License Agreement also applies. If these Terms conflict with mandatory Apple terms, Apple’s terms control to that extent.
16. Governing law and jurisdiction
These Terms are governed by the laws of the Sultanate of Oman. Disputes will be handled by the competent courts of Muscat, Sultanate of Oman, except where mandatory consumer law provides otherwise.
17. Changes to these Terms
We may update these Terms and post the revised version with a new effective date. If required, we will provide additional notice. Continued use constitutes acceptance where legally permitted.
